Advice for GB companies exempt through PPORD on maintaining access to the GB and EU markets
GB based companies that are exempt from registration under PPORD had the opportunity to grandfather their EU REACH notifications into UK REACH.
For your PPORD to be grandfathered you should have submitted to the HSE the following information, see Table 1, within 120 days following the end of the transition period:
Table 1: Information required for the 120-day PPORD notification Legal reference Article 9
The submission process didn’t incur any fee.
The grandfathered PPORD will still have the same conditions that were imposed by ECHA and existing validity will be maintained.
The exemption will expire on the date that was granted under EU REACH unless you request an extension from the HSE.
It was possible for a GB based manufacturer or formulator to transfer their PPORD notification to an Only Representative based in the EU before the end of the transition. The transfer process is now closed.
It is important to note that a change of legal entity can’t extend the scope of the original application for PPORD e.g. to cover different uses.
GB companies no longer have full access to their REACH IT accounts. They however maintained access to their message boxes.
